1. About the Game & The Developer

Blimpies (the "Game") is a cozy, tactile mobile puzzle game developed and published by Chalk Cloud ("we", "us", or "our"), an independent mobile game developer. If you have any inquiries regarding these Terms, contact us at anandjk1042@gmail.com.

2. Eligibility & License Grant

Subject to your compliance with these Terms, Chalk Cloud grants you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and play Blimpies on authorized devices for personal, non-commercial entertainment purposes.

If you are under the age of majority in your jurisdiction, you represent that you have received permission from your parent or legal guardian to play the Game and make in-app purchases.

3. Virtual Items & Virtual Currencies

Blimpies features virtual gameplay mechanics and items, including:

• Virtual Coins: In-game currency earned through gameplay milestones, discoveries, daily challenges, watching rewarded ads, or purchased via in-app purchases. Used to unlock themes, continue runs, or replenish lives.
• Stars: Premium virtual currency earned through daily challenges or purchased via in-app purchases. Used for unlocking premium themes and special perks.
• Lives: Energy units required to start game runs (maximum of 3 lives, regenerating automatically at a rate of 1 life every 30 minutes, or refillable with coins).
• Boosters (Balloon Poppers): In-game utility tools used to pop troublesome balloons during a game run.

Legal Clarification Regarding Virtual Goods:

• Virtual Coins, Stars, Lives, and Boosters are licensed gameplay features, not personal property.
• Virtual items have no real-world monetary value and do not earn interest.
• Virtual items cannot be redeemed, sold, exchanged, or refunded for real-world currency, tangible goods, or services from Chalk Cloud or any other party.
• Virtual items cannot be transferred between different devices or users.

4. In-App Purchases (IAP) & Billing

Blimpies offers optional in-app purchases, including consumable Coin and Star packs, as well as a permanent "Remove Ads" option.

• Payment Processing: All in-app purchases are processed exclusively through Google Play Billing. Your transaction is subject to Google Play's Terms of Service and payment policies.
• Pricing: All prices are displayed in your local currency through Google Play before purchase confirmation. Chalk Cloud reserves the right to adjust virtual item pricing at any time.
• Finality of Purchases: Unless otherwise required by mandatory consumer protection law or Google Play refund policies, all purchases of virtual items are final.

5. "Remove Ads" Purchase

Blimpies offers a "Remove Ads" in-app purchase. When purchased:

• All automatic interstitial advertisements that occur between game runs or game-over transitions are permanently disabled.
• Optional Rewarded Ads Remain Available: Rewarded ads (such as voluntarily watching an ad to earn extra coins or revives) will remain accessible at your choice, so you can still earn voluntary rewards if you wish.

6. Rewarded Advertisements

You may voluntarily choose to view rewarded video advertisements provided by Google AdMob in exchange for in-game rewards. Advertisements are subject to availability, device network connectivity, and third-party ad inventory. Chalk Cloud makes no guarantee that rewarded ads will always be available on demand.

7. Local Save Data & Risk of Progress Loss

IMPORTANT NOTICE REGARDING GAME DATA:

• Blimpies stores all player progression, high scores, unlocked themes, consumable balances (Coins, Stars, Boosters), and settings strictly on your local device storage.
• Blimpies does not operate a cloud account system. Your progress is not synced across multiple devices or backed up to remote Chalk Cloud servers.
• If you uninstall the game, clear application storage in Android Settings, factory reset your device, or lose access to your device, all local game progress and unspent virtual items will be permanently erased.
• Chalk Cloud cannot recover, restore, or reimburse lost local progress or virtual balances resulting from uninstallation, device replacement, or cleared storage.

8. Refunds Through Google Play

Because all billing is handled directly by Google Play, refund requests must be submitted directly through Google Play in accordance with Google Play's standard refund policies:

To request a refund, please visit the Google Play Help Center (Request a refund on Google Play). Chalk Cloud cannot directly issue financial refunds for transactions handled by Google Play.

9. Game Updates & Balance Changes

We are dedicated to maintaining a balanced, delightful experience for all players. Chalk Cloud reserves the right to update, balance, modify, patch, or alter the game at any time, including:

• Adjusting merge scores, combo multipliers, booster costs, or coin rewards.
• Adding, modifying, or retiring puzzle themes or visual assets.
• Correcting bugs or technical performance issues.

Such adjustments will not entitle you to any refund or monetary compensation.

10. Intellectual Property Rights

All title, ownership rights, and intellectual property rights in and to Blimpies—including but not limited to character designs, artwork, graphics, themes, audio, music, animations, user interface, software code, and the name "Chalk Cloud" and "Blimpies"—are owned exclusively by Chalk Cloud. You may not copy, reproduce, distribute, reverse engineer, or create derivative works based on Blimpies without our prior written consent.

11. Prohibited Conduct

When playing Blimpies, you agree not to:

• Decompile, reverse engineer, disassemble, or attempt to derive source code from the application, except as permitted by applicable law.
• Use unauthorized third-party software, cheats, mods, memory editors, or automation tools to alter gameplay or manipulate virtual currency balances.
• Exploit game bugs, glitches, or vulnerabilities for unfair advantage.
• Interfere with or disrupt the operation of advertising or billing services integrated into the game.

12. Disclaimer of Warranties

BLIMPIES IS PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHALK CLOUD EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, SECURE, BUG-FREE, OR COMPATIBLE WITH EVERY HARDWARE CONFIGURATION.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL CHALK CLOUD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE BLIMPIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE GAME SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR IN-APP PURCHASES IN BLIMPIES DURING THE SIX (6) MONTHS PRECEDING THE CLAIM.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law principles. If any dispute arises between you and Chalk Cloud, we encourage you to contact us first at anandjk1042@gmail.com to seek an amicable and informal resolution.

15. Changes to Terms

We may revise these Terms of Service from time to time. When changes occur, the updated Terms will be posted on this page with an updated "Effective Date". Your continued use of Blimpies following any modification constitutes your acceptance of the revised Terms.
